Terms & Conditions

These Terms & Conditions (the "Terms", "Agreement") constitute a legally binding contract between you (the "User", "you") and CHIKY TECHNOLOGIES LLC ("Chiky", "we", "us", or "our"). This Agreement governs your access to and use of the Chiky mobile application, our website (chiky.me), and all associated live video routing, text messaging, virtual coin store, and social interaction services.

By installing the App, completing account registration, or making a virtual coin transaction, you confirm that you have read, understood, and agreed to be bound by these Terms, our Privacy Policy, and our Refund Policy. If you do not agree, you are prohibited from using the Platform.

1. User Eligibility

To protect our broadcasting environment, Chiky is strictly restricted to mature audiences. You must be at least **18 years of age** (or the age of legal majority in your jurisdiction) to establish an account or purchase coins on our Platform.

By accessing Chiky, you represent and warrant that you possess the full legal capacity to enter this Agreement, have never been suspended or banned from Chiky previously, and are not a convicted sex offender or prohibited from using social entertainment software under United States or international export sanctions.

2. Account Registration & Safety

When creating your Chiky account, you agree to:

• Provide accurate, current, and complete profile information, including a valid mobile number or social sign-on.
• Maintain the absolute secrecy of your login passcode, authentication keys, and wallet details.
• Accept sole responsibility for all actions, broadcasts, purchases, and gift deliveries executed under your account credentials.
• Notify our team immediately at support@chiky.me if you suspect unauthorized access or a security breach.

3. Live Streaming & Broadcast Guidelines

Broadcasters on Chiky are public entertainers representing our community. You hold sole liability for your streams and agree to comply with our broadcast guidelines:

• Broadcaster Rights: You must own or hold explicit broadcast licenses for all audio, gaming feeds, or video streams displayed during your sessions. Streaming copyrighted television feeds, music, or films without authorization is strictly prohibited.
• Interactive Chats: You must maintain civilized stream rooms, actively blocking or reporting viewers who engage in toxic, racist, or harassing comments in your public live chat.

4. Virtual Gifts and Coins Policy

Chiky operates a virtual ecosystem where users purchase digital tokens called "Coins" to buy animated digital items ("Gifts") to support live creators.

5. Prohibited Activities

You agree not to engage in any of the following restricted activities while utilizing the Platform:

• Broadcasting explicit sexual media, nudity, extreme violence, self-harm representations, or hate speech targeting race, gender, religion, or sexual orientation.
• Operating automated scripts, scraping algorithms, web spiders, or cheat clients to harvest platform user data or artificially inflate stream viewership/likes.
• Using stolen credit cards, compromised PayPal wallets, or artificial emulator scripts to execute fraudulent coin transactions.
• Promoting commercial gambling, illegal substances, multi-level marketing schemes, or unsolicited advertising.

6. Suspension & Account Termination

We operate a strict, zero-tolerance trust and safety system. CHIKY TECHNOLOGIES LLC reserves the right, in its sole discretion and without prior warning or liability, to suspend, restrict, or permanently terminate your account if:

• You violate any clause of these Terms, the Privacy Policy, or Community Guidelines.
• Your live broadcasts or comment history trigger multiple verified moderator flags or user safety reports.
• Your credit card payments are flagged as fraudulent, unauthorized, or disputed by our financial processing institutions.

Upon account termination, your right to access the Platform terminates instantly. All virtual coins, gifts, and levels accumulated in your profile are forfeited immediately and are non-refundable.

7. Intellectual Property

Platform Ownership: All custom code, graphic layouts, UI flows, animated gift designs, logos, databases, and trademarks (including "Chiky" and "Live • Chat • PK Battle") are the exclusive property of CHIKY TECHNOLOGIES LLC and are protected by US and international copyright, trademark, and trade secret laws.

User Content License: By broadcasting, posting comments, or sharing photos on Chiky, you retain ownership of your media, but grant Chiky a worldwide, royalty-free, perpetual, sub-licensable, and transferable license to host, stream, cash, store, distribute, reproduce, edit, and publicize your broadcasts across our servers, platforms, and media channels.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY GOVERNING LAW, CHIKY TECHNOLOGIES LLC AND ITS SUPPLIERS PROVIDE THE PLATFORM "AS IS" AND "AS AVAILABLE" WITHOUT ANY EXPRESS OR IMPLIED WARRANTIES.

WE SPECIFICALLY DISCLAIM ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR CONTINUOUS UPTIME. IN NO EVENT SHALL CHIKY TECHNOLOGIES LLC, ITS DIRECTORS, OR EMPLOYEES BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES (INCLUDING LOSS OF PROFITS, DATA LOSS, OR SYSTEM DAMAGE) ARISING OUT OF YOUR USE OF THE APP OR UNSAFE INTERACTION WITH OTHER USERS.

9. Governing Law & Dispute Resolution

This Agreement, and all disputes, chargeback evaluations, or legal actions arising out of your relationship with Chiky, shall be governed by, and interpreted in accordance with, the laws of the **State of Delaware, United States**, without regard to conflict of law principles.

Any legal dispute that cannot be resolved amicably through our customer support channels must be submitted to confidential, binding arbitration in Wilmington, Delaware, administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules.
